Year 2000 Inventory of Commercial ActivitiesDear Mrs. Mathews:
The John F. Kennedy Center for the Performing Arts has received the above referenced transmittal regarding implementing the statutory requirements of the Federal Activities Inventory Reform Act ("The FAIR Act"), Public Law 105-270.
As an independently administered bureau of the Smithsonian Institution, the Kennedy Center, like the Smithsonian, is a trust instrumentality of the United States not in the executive branch and is not an "agency" as defined under the FAIR Act. As such, it is not subject to the FAIR Act processes. However, the Kennedy Center is pleased to provide voluntarily information to the Office of Management and Budget regarding its Full Time Equivalent personnel.
Because the FAIR Act does not apply to the Kennedy Center, we do not believe that OMB is required by section 2(c)(1)(B) of the Act to publish a notice of availability in the Federal Register. If OMB does choose to list the Kennedy Center among those entities that have provided information consistent with the Act's requirements, we request, as the Smithsonian has requested, that you note in the publication the Kennedy Center's position that submission of the inventory is voluntary and not mandated by the Act.
